ELECTRIC-HYDRAULIC LOG SPLITTER WARRANTY AND RETURN POLICY
This Policy is effective from 7-21-2004 until unspecified date.
Customer understands that the use of these products can cause injury and to prevent it he/she will use the necessary equipments such as helmet, face shields, gloves and holds Seller and his agents harmless from any liability. Purchaser obtains her/his own insurance if necessary. Seller assumes no suitability of any of these products as to size, color and those others largely depend on personal discretion. Seller will not be held liable under any circumstances for incidental or consequential loss or damage or injury, due directly or indirectly from the use of this product including any malfunction. Must be used by a person of legal age. This shall not act a waiver of any implied warrantees which customers retains, as provided by law. Warranty remains in effect if the warranty work is done by a company authorized person. Only persons of legal age with normal mental soundness can use the products.
Try-out period: customer receives a 30 days try-out period on our omegasplitGold, omegasplit2007, omegasplit2008 models and not on the omegasplitx model, in which customer can try our products. The 30 days begins when product is received by customer and ends when we receive it. Customer has the following obligations when sending product back to us: pack the product with it's original documents and parts, must use extra cushion to protect it from being damaged as the original packing material will not be sufficient for the second route, insure it, must notify us before shipping to obtain a RAM (returned merchandize authorization number) that must be displayed on packages otherwise it will be rejected. Refund will be issued within 30 business days after product is received at company's location without the 25% restock fee for purchases made after 7-21-2004. Shipping cost must be paid by customer. The higher value of Both ways actual shipping cost - the Free shipping indicates that the actual shipping cost was paid by us when the product was shipped to Customer - plus the $95.00 handling fee must be paid by customer. Refund will be processed to the same account that was used to make the purchase minus above described charges. No refund will be issued if the merchandize arrives in damaged, abused or non-operational condition. In such case customer will be notified to arrange the pick up of his/her product at his/her own cost. Try-out means that Customer can view product in his/her own location but it is not designed to provide a free splitting option then sending the product back for full refund. If product shows excess signs of use than the $39.50 per day usage fee will be deducted from Customer's account. This begins when product is received by customer and ends when we receive it. If product becomes unusable while in the tryout period, than company offers repair or replacement and the tryout becomes void.
Damaged merchandize: any type of damages including concealed damages must be reported to both omegastores.com and the shipping company within 24 hours from the receipt of good(s). We may use any carrier other than UPS or FedEx and they require this short notification in order to process the claim. If the damage is not reported within this period, customer forfeit his/her rights to claim the merchandize to be damaged, and therefore we will not be able to compensate customer with this claim either. Orders canceled due to damage will be subject to the 25% cancellation fee.
Defective and/or not complete merchandize: if customer receives the product(s) in good condition (not damaged) and or with missing part(s) and the item does not work as being defective, than customer must report such a case to company by email or fax and not by phone within three days from the receipt of said product. If customer neglect to report defectiveness within this period than customer forfeit the right to claim the merchandize to be defective. Defective product cannot be used.
Refused product(s): If Customer refuses product for any reason than the 25% refusal fee and the actual two-way shipping fee shall be paid from customer's account. Customer agrees not to refuse box(es) that show sign of puncture caused by the shipping company or box that show signs of oil due to the nature of these hydraulic products, but must examine product first and notify Company if there is any problem. If there is, Company shall provide technical help and/or send missing item or replacement part to Customer. Customer bears responsibility for damages of refused products as extra cushion is needed to protect them from being damaged since the original packing material will not be sufficient for the second route due to the heavy weight of such items.
Cancellation: order cancelled after the product is shipped will incur a 25% restock fee and the two- way shipping charges. All cancellation must be made in writing. Orders cancelled after they had been processed but not yet shipped will incur a 5% processing charge.
We gladly accept credit cards, check and money order in form of payment for any of our goods. By placing your order with a credit card, you agree to use your own credit card and waive your right for billing dispute directly with your credit card company and commit yourself to the Good-behavior policy as stated below:
Good faith behavior: Customer agrees that any problem must be solved with Company first before using any other method or channel. Communications must be made through email or fax. Customer agrees not to refuse item(s) that show sign of puncture caused by the shipping company or box that show signs of oil due to the nature of these hydraulic products, but must examine product first and notify Company if there is any problem. If there is, Company shall provide technical help and/or send missing item or replacement part to Customer. Also, Customer agrees to notify Company of any technical problem and Company shall offer technical help and/or replacement part but Customer does not return item or request return before attempting to resolve such problems. Customer also agrees not to dispute charge amount in case of any such problem before attempting to resolve it with Company in writing. If dispute is placed on any purchases that Company reserves the right to have Customer ship item to Company on Customer's expense and the $75.00 dispute fee shall be paid to Company.
Returned check/money order: returned checks/money orders are subject to a $20.00 service fee.
These products are designed for household use and not for rental or industrial applications.
The warranty is 1 year from the date of purchase on mechanical parts, electrical parts and labor excluded. During this period company will replace defective items or parts at his location. Product must be delivered to company for warranty works postage and re-shipment prepaid by customer with the receipt. Labor charge will be determined when product is received and customer will be notified. Customer can request replacement parts from company during this warranty period and must send broken part(s) to company prior to receiving replacements. Requesting parts do not mean authorized work. In case of unauthorized service this warranty will become null. We have the right to issue an in-store credit.
